In this show, we discuss how to use creativity your compliance communications to have a more effective compliance program by producing a more robust Speak Up culture in your organization. The recent DOJ 2020 Update to the Evaluation of Corporate Compliance Programs stated the following: Other companies have invested in shorter, more targeted training sessions to enable employees to timely identify and raise issues to appropriate compliance, internal audit, or other risk management functions. How does Speak Up compliance training fit into this new mandate? 

Some of the highlights include:

• Why is this change both significant and importantly was is the Government’s expectation? What is the difference between “shorter” and “targeted” training?
• The DOJ has acknowledged what most successful programs have known for a while. That shorter, more frequent training and communications are more effective. Most adult learning principles support this.
• Training is important, but it should be shorter, relevant and interesting.
• Comms is separate. It services a different purpose.
• To advertise where resources are.
• To drive traffic to those resources – teach people where to go.
• To remind people and reinforce resources and themes.
• “Enable employees to timely identify and raise issues”
• That is making resources accessible and easy to use
• Show up in more places – Apps, Newsletters, Intranet Posts, email signature, in the mouths of leadership
• It’s also about making people know that they are safe
• Targeted is focused on making training relevant. Corporate comms can go to everyone, everywhere, all the time. Training should be tactically relevant to job function.
• Learnings and Entertainments creates short stories about specific issues so that companies can deploy those to those specific audiences.
• Broadcat makes job aids which are helpful in this regard.
• Offerings are aligned with what the DOJ is recommending in their 2020 update.
• “Hey maybe a group of comedians and improvisers have something to offer.”
• L&E’s whole business is structured around two things.
• Promoting E&C as helpful advisors and coaches.
• Promoting Speak Up culture.
• Short, Entertaining, Memorable Comms & Awareness – this is designed to raise the visibility of the issues policies and resources so they are easy to access. Show up in more places. Try to shift attitudes and behaviors over time.
• Person on the Street Campaigns – gives voice to employees. Makes it less preachy.
• Stories that shed light on the speak up process – share why things happen and the results of those things. Very specific and targeted learning.
• Talk Shows that help leaders shed light on the speak up process – build trust.
• Improv Training to help leadership encourage speak up culture.

In this  episode, we discuss how to use creativity your compliance communications to have a more effective compliance program by producing a more robust Speak Up culture in your organization. In a prior podcast, we established that a Speak Up Culture requires trust and that requires changing the social environment.

Some of the highlights include:

• How do you change your organization’s social environment to create trust?
• It is more than simply training.
• You must continually reinforce the right kind of behaviors and attitudes – over and over and over and over again. 
• Overcoming message fatigue.
• If you don’t want message fatigue and you don’t want people to tune you out, you need to be creative and interesting and you need to change up the delivery mechanism to keep it fresh. You actually want your message to be jarring in a way.
• It’s important to be interesting and entertaining, so you can put it in more places. Show up where people are. 
• Integrate into other department trainings, newsletters, meetings. 
• Use social collaboration sites. 
• Get on the video message boards. 
• Play commercials. 
• This only happens if your programming is interesting.
• It should be Positive not Preachy. Scare tactics drive bad behavior underground.
•  Have the message come from employees. Person-on-the-street campaigns have been successful because it comes from the people saying, this is how we feel about it. We are the kind of company that speaks up.
• Why is transparency so important?
• To build trust, you need to shed light on the process. Transparency is the key.
• Share what happens after people speak up and highlight confidentiality in the process.
• Highlight that all reports are followed up on.
• Tell stories about things that happened – masked to protect the innocent/guilty. 
• This will help you build trust over time.
• And what about training?
• Training, but training for management. 
• Create a Listen Up Culture for Management.
• Campaigns targeted at leadership. Give them a simple process for them to get help on what to do. Make it simple.
• Give them training – teach and then use improv skills to help them be more welcoming and approachable.

 Some of the highlights include:

• What is a Speak Up Culture?
• Define it as creating a social environment where employees feel comfortable speaking up to ask questions and report concerns and they know the options for doing that.
• Why is it so difficult to achieve?
• Intertwine it with training – which means its infrequent
• It’s usually boring and not particularly creative – dull posters
• They make it “inspirational” which often comes off as preachy or inauthentic
• Or perhaps they do a campaign but that campaign is once a year for a few weeks or worse, every other year.
• This is largely ineffective
• We’ve all heard the excuses.
• Grew up with – It’s not cool to tattle. Don’t be a snitch
• Nothing will happen anyway
• Someone else will probably take care of it
• I don’t want to get anyone in trouble
• I’m a no drama llama
• THEREFORE – you have to actually reverse this kind of thinking, which takes time.
• How can you establish trust?
• Comms are more important than training – continually promote and do so creatively so people pay attention and remember.
• Transparency – share what happens – in aggregate. Tell stories.
• Share the mechanics of the process
• Make personal connections – you and your team need face time
• Listen Up Culture – provide skills and resources for management – we do improv training to support that
•  
• Can you do this in the new WFH environment?
• Sure. Comms are even more important.
• Commercials during zoom meetings
• Stories – discussion groups
• Talk Shows & Podcasts – to get your face out there, answering questions.

In today’s episode A Video Isn’t a Video – we discuss some of the creative approaches to Ethics & Compliance training and communication videos. We break down some of the different types of videos and the benefits of each creative technique.

Scenario-Based Videos, Narrative (Live Action)

These are the most common and are great for showing real life situations. They can show a slice of life. However, it may be hard to represent your whole company, i.e. hard to show diversity of different environments, different people. Also, they can require context – you may well need to add the lesson. They are the most expensive and the hardest to pull off well and the hardest to successfully enact.

Animation – Scenario-based

The tend to be less real and unfortunately can be cheesy. However, they can be better for diversity and environment. They are usually the same per video, but you can do them one at a time.

Character Monologues (falls in the “real” category

They are a great way to show real people. They are also great for showing different types of personalities or different job functions. There is more telling than showing. Finally, they are less expensive and easier to produce.

Talking Head Videos

These are great for making a personal connection and for highlighting real people. They are best if you add some creativity usually by having an engaging host/personality. Make it a dialogue such as an interview or talk show. You have to work as this format can be boring.

 Involve Your Employee Videos

This format is the best for going viral and for showing “who we are”. At times scenes can be hard to do well and there is the risk of employee embarrassment. The best results tend to be seen when you give employees something simple to do and let them be themselves. Once again it is best if you add some an engaging host/personality to lead interviews. Finally, this format can be an efficient way to generate a lot of content.

Storytelling Videos 

This can be a great way to share interesting, real stories. It tends to be more telling than showing. It can easily involve real people or actors and can cover more nuance to share lots of context.

The bottom line is that a video isn’t a video. There are different creative devices that are better for different things. Typical Ethics & Compliance training doesn’t work, because it’s preachy and boring. Education = training and communication and serve two different purposes.

• Always remember, you are only limited by your imagination.
• Maintain Fun – Variety and Surprise. Novelty breads engagement. Need to constantly switch it up. Try lots of little things.
• What are some of the additional pluses during this current time?
• These formats are powerful mediums that can be digested in small increments when working remotely.
• You can still make a personal connection.
• You can still educate and make the training/communication interesting.
• It can all be digested on the employees time.
