The CDC Rental Eviction Moratorium has undergone changes and from the beginning there was concern from many that an agency, with unelected bureaucrats, could suddenly for their own reasons essentially seize private property, disrupt private contract and impose nationwide mandates far exceeding laws passed by Congress and signed by a President.

In my August 30th blogpost entitled “Alabama Association of REALTORS wins at Supreme Court – CDC Rental Eviction Moratorium” I put together a timeline of the actions since March 27th 2020 leading up to the August 26th 2021 Supreme Court ruling.

According to a June 2020 HUD rental survey, 73% of residential rental properties are owned by individuals and another 16% of rental properties are owned by LLCs. We know a large percentage of LLCs owning rentals are made up of 1, 2 or 3 individuals who choose to establish an LLC for liability or tax purposes. The vast majority of our residential rentals (80% or more) are owned by small investors.

On May 6, 2021, the Arizona Department of Water Resources published the April 29th Joint Colorado River Shortage Preparedness Briefing. The briefing outlined the water shortage issues along with what declaring a Tier 1 shortage will mean for Arizona.

How much money is your City or Town getting from the recently passed American Rescue Plan, and how will they spend it?  You can read the bill at www.weservgad.org. Now we are seeing estimates of how much money cities and towns will receive as direct funding. There are other funds in various portions of the bill, but the direct funding to cities and towns has Arizona’s total estimated at over $1billion, 233 million dollars. I have a list of cities and towns in the WeSERV jurisdiction with estimates of funds to be received.

SB 1377 – In April, the Arizona State Legislature passed and the Governor signed SB 1377 which limits the liability of businesses and other service providers. 

Affordable Housing:  In mid-April I did a quick survey of communities in the WeSERV area who were addressing Affordable and Workforce housing in the first quarter of 2021. . You can see a list of these cities and towns, along with links to their various programs and discussions at www.weservgad.org.

The Arizona State Legislature is a bit more than 70 days into the legislative session and currently there are 89 new laws passed by the Legislature and signed by the Governor.

New laws take effect 90 days after the legislative session, unless the bill stipulates a different effective date. I highlight a few of the new laws I think you should be interested in knowing.

Transportation:

Cities and Counties all over the state are assessing transportation needs for the next 20 years. Peoria, Surprise, Gilbert and the Maricopa Association of Governments are all conducting transportation surveys. Check your city and county to see if they are surveying transportation needs and wants and fill out the survey.

The WeSERV Water Issues Task Force subgroup has released its first information flyer named Water in Arizona – Is My Property in an AMA or INA? Here you will find links to primary sources of information and a short description of key water terms. Most important this document is full of links to primary sources so you can be the “source of the source” to your clients. This is the first in a series of Water in Arizona flyers.

WeSERV has attended stakeholder meetings in the City of Surprise that have lasted over a year regarding their Land Use Ordinance update. On Tuesday, Dec 15th the City Council will discuss the proposed updates to the narrow/small lots part of the ordinance. You can read the proposed changes and get more information on the meeting at the City of Surprise website.

There are numerous laws that were enacted beginning in March 2020 that mandate business provide certain FMLA (Family Medical Leave Act) benefits no matter how small the business is. That mandate led to business, particularly small business, needing financial grants and loans to survive. The transition for employees and employers may be more difficult than anticipated. If you or someone you know is a small employer, make sure to work with someone who can help orchestrate the transition and update your employees so they know what to expect.

The West Valley Government Affairs Committee is forming, so watch the WeSERV newsletter to find the committee interest form. Although we are going to a committee structure, we will still bring you the elements of the Council forums. Starting with our first meeting on Feb.25th we will have a forum component to our meetings.
