At our January Government Affairs Advisory Council Meeting in West Valley, our Lunch & Learn guest was Judge Craig Wismer of Arrowhead Justice Court. Judge Wismer discussed the role of Justice Courts and the Justice of the Peace in Arizona courts, contract adjudication, court protocol and what you need to know if you appear before a Justice of the Peace. SB 1021 is the bill Arizona REALTORS supports that allows the Arizona Department of Revenue to accept electronic signatures. It has been amended by Senator Ugenti-Rita. You can read the amendment, the Senate Summary and the Senate Engrossed bill at www.weservgad.org. The bill was transmitted to the House on Feb. 3rd.

SB 1129 is the bill Arizona REALTORS supports that allows a non-licensed employee of real estate brokerage to accept rent checks as part of their clerical functions. It was heard in the Senate Commerce Committee on Feb. 6th and will be heard in the Senate Rules Committee on February 10th. The bill originated in the House as HB 2351 with one amendment prescribing a receipt be provided if rent is paid in person.

REALTOR® Day at Capitol was on January 14th. I was able to catch up with Tom Farley of Willetta Partners to discuss the two bills AR is in support of that help property managers; SB 1021 and SB 1129.

Other interviews were new AR Government Affairs Director Matthew Contorelli, Senate Majority Leader Rick Gray and Representative Sierra.

Here are the election dates for 2020 in Arizona:

March 10, 2020 – you must register to vote no later than Feb 10th 2020. ouglas will have its primary election on March 10th. Offices on the ballot are Mayor (4 candidates), Ward 1 (2 candidates), Ward 3 (2 candidates) and Ward 5 (2 candidates). You can read more about the candidates and races and check the Ward Location Map at www.weservgad.org. You can also follow links to the Douglas City Clerk’s website and register to vote.

March 17, 2020 – The Presidential Preference election. You must be registered to vote by February 18, 2020. The only political party participating in the March 17th election is the Democratic party.

May 19, 2020 – If your area has an election this date, you must be registered to vote no later than April 20, 2020.

August 4, 2020 – Primary Election – For most cities and counties this will be a big election. To vote in the primary election, make sure you are registered to vote no later than July 6, 2020.

November 3, 2020 – General Election – Most local elections will have been finalized at the primary, but runoff elections from the Aug. 4th primary for locals will take place on this this date. Also, on the ballot, the President and federal legislators.

At the December 3rd Surprise City Council meeting the Surprise City Attorney recommended, and the Council unanimously passed, an amendment to the City code removing “REALTOR” from Section 26-66 and removing Section 26-67(b) from Article III of the Surprise Municipal Code.

The CFPB and the FTC are holding a workshop on December 10th, 2019 to discuss the issues affecting the accuracy of traditional credit reports, employment background screenings and tenant screening reports. The public comment period closes January 10, 2020. You must submit your comments online at www.regulations.gov. or mail them to the FTC.

The Arizona Association of REALTORS has opened registration for REALTOR Day at the Capitol 2020. REALTORS from across the state will come together on January 14th, 2020 at the State Capitol to listen to updates on real estate in Arizona and the upcoming legislative session as well as meet and eat lunch with their state legislators. WeMAR is now WeSERV Association of REALTORS® with members in West Maricopa County, Southeast Maricopa County, Pinal County and Douglas, Arizona.

I attended the National Association of REALTORS® Conference and Expo in San Francisco last week. One of the sessions I attended was in regards to federal policy and data security. Alex Stamos, professor at Stanford, Fellow at the Hoover Institution and ex-head of cybersecurity for Facebook spoke on Information Warfare, Election Hacking and, and the 2020 Election. You may access the audio at playbacknar.com.

When discussing government policy and platforms such as Facebook, Twitter and Google, the discussion usually revolves around policy vs. platform. As I discussed in the November 29, 2018 blog post Personal Data as Property, an increasing number of judges, including Supreme Court judges, are attaching the bundle of property rights to private data. Read Justice Gorsuch’s dissenting opinion (page.99) in Carpenter v. United States.

Here is the question: Do you want to preserve the right to have private data and documents? Of do you prefer to allow policy drawn up by the government, educational institutions such as Stanford and Harvard, and the platforms themselves, decide your rights to your private data? Is paternalism really the best answer for the individual’s wellbeing? Is platform policy to be discussed and decided without any consideration given to the private property rights affected?
